Preamble

The present General Terms and Conditions of Sale (referred to as T&Cs) apply to products sold by Gamezest on its website gamezest.ch. By placing an order with Gamezest, the Client accepts the application of these T&Cs without any modifications and in their entirety. The T&Cs are subject to Swiss law and are only available in French. They can be updated without notice: the latest version of the T&Cs is always available on the website gamezest.ch.

E-commerce in Switzerland is primarily governed by the Federal Act against Unfair Competition (UCA; RS 241) and the Ordinance on Price Disclosure (OPD; RS 942.211), and in the EU by the Consumer Rights Directive (Directive 2011/83/EU) and the E-Commerce Directive (Directive 2000/31/EC).

Gamezest (hereinafter referred to as The Store) mainly sells trading cards, games, and related products (hereinafter referred to as Products). Buyers (hereinafter referred to as Client) can purchase Products by placing orders on the gamezest.ch website.

Prices

The prices in this catalog are quoted in Swiss francs, net amounts, VAT included and guaranteed. Products with a warranty are subject to the conditions of the offer valid at the time of purchase. The warranty takes effect on the delivery date of the product, as evidenced by the accompanying document (invoice) that we ask you to keep carefully. The following are not covered: damage caused by improper maintenance, failure to follow the instructions, or normal wear and tear.

Order

When the order is registered, i.e., once the Client has read and accepted the General Terms and Conditions of Sale and clicked on the "Order" or "Buy" button, the order is considered fully and unconditionally accepted by the Client.

According to Art. 184 ss. of the Swiss Code of Obligations (CO), a sales contract can be concluded electronically with a single click. A client of a Swiss online store can conclude a sales contract by clicking on the "Buy" button. The condition required: both parties must agree on the essential points, namely the object of the sale, the purchase price, and the conclusion of the sales contract.

Pre-order sales are firm and payable in advance and cannot be canceled or refunded, except in exceptional cases where the release of the Products is permanently canceled by the manufacturer or when the Products are no longer available, for reasons beyond our control. Pre-ordered Products are available in limited quantities and are reserved for the Client once the payment has been successfully made. They will be shipped from the official release date once The Store has received the Products in stock. The Store commits to shipping the pre-ordered Products as soon as possible once they are in possession, but no contractual guarantee can be provided regarding the actual delivery date. Finally, pre-orders are only open to Clients residing in Switzerland or Liechtenstein.

The Store cannot be held liable in extreme situations beyond its control, such as epidemics, pandemics, natural disasters, war, terrorism, national emergency, strikes, etc.

Orders of Products on the gamezest.ch website are reserved only for individuals who meet the minimum age requirement.

Availability

Our delivery commitment is null in the event of supplier failures or delays in supply, to the extent that this unavailability is not attributable to The Store. In case of product unavailability, we will inform you as soon as possible.

Delivery and Transport

The dispatch of available items is carried out by post within approximately 2 to 5 working days. A shipping contribution is requested from you once per order. PLEASE NOTE: The Store does not deliver packages to P.O. boxes and does not deliver any merchandise to minors or clients under guardianship, except with written authorization from parents or guardians.

Return or Exchange of Goods

The Products sold on the gamezest.ch website are carefully inspected before shipment, and two original front and back photos of the Product are systematically taken to guarantee the condition, conformity, and authenticity at the time of postal dispatch. It is also the Client's responsibility to carefully review the specifications and photographs accompanying the Product, so that the purchase is made with full knowledge of the facts. Therefore, according to Swiss law for e-commerce, no withdrawal period or other return rights are provided once the order has been placed: no refund will be made. For EU countries, European legislation applies.

In any case, in case of doubt or complaint, please contact The Store via the contact form available on the gamezest.ch website. If a return is validated by The Store, items must be returned intact and complete in their original packaging (with the labels showing their references), accompanied by the delivery slip, within 14 days after receiving your package. Return shipping costs are at your expense.

Check the condition of the delivered goods immediately to exclude obvious material and manufacturing defects, as well as transport damage. According to the law, you are obliged to report any defect or anomaly affecting the delivered goods to us so that we can remedy it.

Reservations and Club Site

The club.gamezest.ch site is an integral part of gamezest.ch and allows users to reserve products before their release date. This serves as a pre-order.

Obligations Regarding Reservations

Any product reservation serves as an order of merchandise, subject to availability from the supplier.

Clients making a reservation on The Store are contractually bound to purchase the reserved merchandise upon its release and payment of it before delivery once allocations are confirmed.

Once a reservation has been placed in validated request status, the Client can no longer cancel it.

Availability of Reserved Products

The Store depends on the supplier for quantities delivered and any changes to the release date. The Store cannot be held responsible for any modification of the final product availability date.

The Store cannot be held responsible for a lack of quantity to fulfill all reservations, as it relies on stock allocations from the supplier. Final product allocations according to reservations are prioritized based on earlier reservations. Allocations are also proportionally reduced depending on the quantities reserved.

Any reservation that has been paid for in advance but whose total product availability cannot be fulfilled will be refunded to the extent of the missing products.

Data Protection

All personal data will be considered confidential. Information necessary for order management will be subject to computer processing and may be communicated to associated companies in the context of order management.

The Store only uses the indispensable personal data of Clients to ensure the proper functionality of its website and to guarantee the smooth processing of orders. The Store treats personal data seriously, rigorously, and in a targeted manner in compliance with applicable data protection laws.

The Store may use Client data for communication purposes, primarily to send information about new products available for sale on the gamezest.ch website. It is possible to unsubscribe at any time.

Access to Personal Data

In accordance with the Federal Data Protection Act, personal data stored can be accessed, rectified, or deleted at any time by simply sending an email to The Store at contact@gamezest.ch.

Applicable Law and Jurisdiction

The applicable law is Swiss law, and any dispute will be handled by the District Court of Broye and Nord Vaudois.
